What is an Annulment in California?
An annulment is a legal action that ends a marriage by declaring that the marriage never happened. It is essentially a legal nullification that is based on the premise that the marriage is void.
To be eligible for an annulment in California, certain grounds or reasons must be met. These grounds include:
- Incest: If the spouses are closely related by blood, such as siblings or parents and children, the marriage may be considered void and subject to annulment.
- Bigamy: If one spouse was already married to another person at the time of the marriage, the subsequent marriage is voidable and can be annulled.
- Age: If one or both parties were underage (under 18 years old) at the time of the marriage and did not obtain parental consent, the marriage may be annulled.
- Prior existing marriage: If one spouse had a prior existing marriage that was not legally terminated (divorce or annulment) before entering into the current marriage, the later marriage may be voidable.
- Unsound mind: If one of the parties lacked the mental capacity to understand the nature of the marriage or give consent due to mental incapacity or impairment, the marriage can be annulled.
- Fraud or misrepresentation: If one party was induced into the marriage based on fraud, such as lies about important aspects like fertility, religion, or intention to have children, the marriage may be voidable.
- Force or duress: If one party was forced or coerced into the marriage against their will, the marriage can be annulled.
An annulment is different from a divorce, which is based on the premise that the marriage exists but is no longer viable. An annulment is granted when the marriage never existed.
