The California Adoption Process
Our process begins with research and preparation, an adoption orientation, and the selection of an agency or attorney when applicable. The remaining steps depend on the type of adoption, the child’s circumstances, and whether parental consent is available.
Common stages in an adoption include:
- Completing the required home study
- Filing the California adoption petition
- Obtaining consent or addressing termination of parental rights
- Completing post-placement supervision
- Attending the adoption hearing
- Receiving finalization from the court
A home study evaluates the prospective adoptive home and gathers information required for the placement. In a direct-placement case, an adoptive parent must generally be at least 10 years older than the child. Every California adoption also requires a petition filed in the Superior Court for the county where the adoptive parent or parents live.
Before the court can finalize the adoption, a biological parent’s rights must be voluntarily relinquished or terminated by the court. We help clients identify the necessary consent documents, notices, and court proceedings so this legal transition is handled correctly.
Orange County Court Procedures for Irvine Adoptions
Adoption cases for Irvine, California residents are filed and heard at the Orange County Superior Court’s Lamoreaux Justice Center. Its Family Law Clerk’s Office handles adoption matters and proceedings involving termination of parental rights.
Prospective parents pursuing a direct placement file a Petition for Adoption and the required Indian Child Welfare Act forms in the county where they live. The Indian Child Welfare Act is a federal law that establishes protections for Native American children, families, and tribes in qualifying child custody proceedings.
Home studies for direct placements in Orange County may include home visits, reference letters, confirmation of employment or income, and fingerprinting. We help families prepare for these requirements and organize their filings according to the procedures for Irvine residents.
Adoption Timing, Consent & Final Documents
Completion times vary. Agency adoptions may take several months to a year, while relative and stepparent adoptions can proceed faster when the legal requirements are met early. Placement circumstances, the home study, consent, court scheduling, and required supervision can all affect timing.
Orange County agency adoptions require a 180-day post-placement wait before finalization. During this period, post-placement supervision follows the child’s transition into the adoptive home before the court grants the final adoption. A child age 12 or older must also consent.
For a direct placement, birth parents generally have 30 days after signing an Adoption Placement Agreement to change their minds. The agreement documents the decision to place the child with the prospective adoptive parents. That 30-day right may be waived through the California Department of Social Services.
After finalization, the court forwards the Court Report of Adoption to the California Department of Public Health or State Registrar. An amended birth certificate can take up to one year after an Orange County adoption is finalized, so families shouldn’t expect it immediately after the hearing.
